Members needed for the 2022-2026 Election Compliance Audit Committee
The City of Timmins is currently seeking interested applicants with accounting, auditing and legal experience, from professionals who are required to adhere to codes or standards of their profession and from individuals with in-depth knowledge of the campaign financing rules of the Municipal Elections Act, 1996, for appointment to the City of Timmins 2022 Municipal Election Compliance Audit Committee.
The purpose of the Compliance Audit Committee is to ensure public oversight of campaign spending finances. The power and functions of the Committee are set out by the Municipal Elections Act, 1996. The Committee is responsible for reviewing and making decisions on applications for municipal election campaign finance compliance audits, and on reports from the City Clerk regarding possible contraventions of contribution limits related to a regular municipal election or any by-election held during the term of office for the City Council for which the Committee was appointed.
The 2022-2026 Election Compliance Audit Committee will:
- within 30 days receipt of a compliance audit application by an elector, consider the application and decide whether it should be granted or rejected;
- appoint a licensed auditor, if the application is granted;
- receive the auditor's report;
- within 30 days receipt of the auditor’s report, consider the report;
- if the report concludes that the candidate appears to have contravened a provision of the Act relating to election campaign finances, commence legal proceedings against the candidate for the apparent contravention; or,
- if the report concludes that the candidate does not appear to have contravened a provision of the Act relating to election campaign finances and the Committee finds that there were no reasonable grounds for the application, Council may recover the audit costs from the applicant.
The Election Compliance Audit Committee’s term of office begins on November 15, 2022 and ends on November 14, 2026.
Eligibility
The Election Compliance Audit Committee will be composed of four (4) members. Membership will be drawn from the following groups:
- accounting and audit - accountants or auditors with experience in preparing or
auditing the financial statements of municipal candidates;
- legal;
- who in the course of their duties are required to adhere to codes or
standards of their profession which may be enforced by disciplinary tribunals;
and/or
- other individuals with knowledge of the campaign financing rules of the Municipal
Elections Act, 1996.
Members will be selected on the basis of the following:
- demonstrated knowledge and understanding of municipal election campaign financing rules;
- proven analytical and decision-making skills;
- experience working on a committee, task force or similar setting;
- availability and willingness to attend meetings; and
- excellent oral and written communication skills.
Municipal employees, members of Council and any candidates in the 2022 municipal election or in any by-election during the term of Council for any member municipality are ineligible to be appointed as a member of the Committee pursuant to subsection 81.1(2) of the of the Municipal Elections Act, 1996.

What is a Compliance Audit?
Anyone who is entitled to vote in an election and believes on reasonable grounds that a candidate or registered third party advertiser is in contravention of the campaign finance rules as set out by the Municipal Elections Act, 1996, may apply for a compliance audit of the candidate's campaign finances. An application for a compliance audit can be made to the City Clerk within 90 days after the candidate's financial filing date.. This application should be in writing and set out the reasons for the elector's belief of contravention.
How to submit a compliance audit application
Complete the Compliance Audit Form.
Submit the completed form in person to Service Timmins during regular business hours Monday to Friday between 8:30 a.m. and 4:30 p.m.
The Election Compliance Audit Committee only accepts applications related to candidates for municipal council and third party advertisers. Applications relating to candidates for School Board Trustee must be made to the secretary of the applicable school board.
